The English version is only translated up to the 7. item but will be completed and uploaded as soon as possible. However, the most important parts, especially the cancellation conditions, are already available in English - see below!

Terms and Conditions

1. General
   Pilgram Apartments rents fully furbished and fully equipped apartments for the purpose of the accomodation of guests. The apartments are rented exclusively for housing purposes. In case of doubt, the orderer is considered as the guest, even if he/she ordered for other persons. The general terms and conditions of Pilgram Apartments, are valid for all services that Pilgram Apartments performs over the contracting party. Pilgram Apartments exclusively performs at this conditions, conflicting conditions of the contracting party will not be acknowleged by Pilgram Apartments. There are no additional verbal agreements between the contracting parties, later changes and amendments require the written form. The verbal waiver of the written form is excluded amicably. The relevant version of the term and conditions is integral part of the contract, which can be found at the homepage of Pilgram Apartments.
   The rent of the apartment includes any auxiliary costs (incl. taxes and other fees and charges) like electricity, water, heating as well as an intermediate cleaning with change of towels at the interval of a maximum of 10 days. New bed linen is available upon request. Smoking is not permitted. No pets allowed.
2. Booking
   Pilgram Apartments accepts bookings, that are transacted by the orderer by any of the following means:
   
   • Online booking
     Pilgram Apartments offers the possibility of self-booking at its homepage. After the booking has been performed, Pilgram Apartments generates an automatic booking e-mail that contains a link to the personal booking page of the orderer. Only if the orderer clicks the button "confirm" at his personal booking page, the booking becomes binding for both sides.
   • Booking via e-mail
     Pilgram Apartments accepts bookings via e-mail at which Pilgram Apartments performs the confirmation of the booking itself. The confirmation of the booking will be send by Pilgram Apartments to the sender of the e-mail.
   • Booking by phone
     Pilgram Apartments accepts bookings by phone. An e-mail address has to be named by the orderer to which Pilgram Apartments sends the confirmation of the booking. In this case, Pilgram Apartments performs the confirmation of the booking itself.
3. Payment
   The rent for the booked apartment is due in full no later than the arrival date. If no other arrangement has been settled in advance, the payment is due in cash. Especially, for long term stays, Pilgram Apartments reserves the right to charge the total amount within 2 weeks after the booking date or else ask for a deposit of 30% of the rent. In the latter case the remaining amount has to be paid in full no later than the date, when 20% of the stay will have passed. The amount is payable in cash or as a wire transfer to an account to be specified by Pilgram Apartments free of any charges, i.e. all possible fees and charges are for the account of the orderer.
4. Wertsicherungsklausel (to be translated)
   Zur Erhaltung der Wertbeständigkeit wird nachstehende Wertsicherungsklausel vereinbart:
   Als Maß zur Berechnung der Wertbeständigkeit dient der Index der Verbraucherpreise 2005 (Basis 2005 = 100), der vom Österreichischen Statistischen Zentralamt monatlich verlautbart wird, im Falle des Auslaufens, der an seine Stelle tretende Index oder jener Index, der dem Verbraucherpreisindex am meisten entspricht.
   Schwankungen der Indexzahl nach oben oder unten bis einschließlich 5 % bleiben unberücksichtigt. Dieser Spielraum ist erstmals von der Indexzahl für den Monat des Vertragsabschlusses und sodann bei jedem Überschreiten des jeweils geltenden Spielraumes nach oben oder unten neu zu berechnen, wobei stets die erste außerhalb gelegene Indexzahl die Grundlage für die Berechnung des neuen Spielraumes zu bilden hat.
5. Key Handling
   On the day of arrival, the keys to the booked apartment can be found in the key safe of Pilgram Apartments. This way, the guests are independent of any office hours of Pilgram Apartments. The check-in procedure is described in detail in the check-in information that can be found at the personal booking page of the guest after confirming the booking.
   
6. Cancellation
   The fees due for a possible cancellation depend on the date the cancellation is received and the duration of the booked stay:
   • Should a cancellation be received no later than 30 days prior to the arrival date of the corresponding booking, the contract can be cancelled by both parties without any costs. Pilgram Apartments will refund any possible deposit or payment made less a handling fee of 20 € to the orderer.
   • Should a cancellation be received no later than 14 days prior to the arrival date of the corresponding booking, the contract can be cancelled by the orderer with costs, which amount to the rent for 3 nights for bookings of 3 nights and more or to the total rent for bookings of 2 nights or less.
   • Should a cancellation be received no later than 5 days prior to the arrival date of the corresponding booking, 60% of the rental rate are due, in any case the minimum due is the rent for 3 nights for bookings of 3 nights and more or the total rent for bookings of 2 nights or less. The maximum due is the rent for one month.
   • Should a cancellation be received within 5 days prior to the arrival date of the corresponding booking or should the guest not show up, the total rent is due up to a maximum of one months rent.
   • Should the guest not show up on the arrival date without informing Pilgram Apartments, Pilgram Apartments reserves the right to cancel the booked apartment anytime. Nevertheless, the total rent is due up to a maximum of one months rent.
7. Arrival and Departure
   Arrival time is any time after 3 pm; departure time is anytime until 10 am.
   Pilgram Apartments does not have a reception that would permanently be busy. Prior arrival times or later departure times have to be agreed upon separately with Pilgram Apartments. Pilgram Apartments will bill another night, if the departure time will not be observed without any prior special agreement.
8. Persons to Stay in the Apartments (to be translated)
   The apartment may not be sublet to other persons. Only persons officially registered at Pilgram Apartments may be accommodated. Leaving the apartment to third parties is strictly forbidden. Bei Verletzung dieser Regelung ist der Vermieter berechtigt, die Aufenthaltsdauer aufzuheben und für die Dauer der vertragswidrigen Nutzung einen Zuschlag für die Überbelegung zu verlangen.
9. Rules of the house (to be translated)
   The house rules regulate the basic requirements, in order to enjoy a comfortable stay in a neat atmosphere for all parties.
   Zur eigenen Sicherheit, zur Sicherheit anderer Gäste und zur Sicherheit von Pilgram Apartments, dessen Personal und Eigentum nimmt der Gast bereits bei Buchung zustimmend zur Kenntnis, dass der Eingangsbereich, der Parkplatz und die allgemein zugänglichen Bereiche innerhalb des Hauses wie das Stiegenhaus von Pilgram Apartments videoüberwacht wird. Die Videoüberwachung erfolgt unter Wahrung des Rechts auf Privatleben des Gastes, dient ausschließlich der Abwehr von gefährlichen Angriffen – bei Bedrohung eines Rechtsgutes durch die rechtswidrige Verwirklichung des Tatbestandes einer gerichtlich strafbaren Handlung, die vorsätzlich begangen und nicht bloß auf Begehren eines Beteiligten verfolgt wird - gegen Leben, Gesundheit, Freiheit, Sittlichkeit und Vermögen von Menschen und als Beweismittel zur Verfolgung bei Verdacht gerichtlich strafbarer oder besitzstörender Handlungen. In den Apartments erfolgt selbstverständlich keine Videoüberwachung. Sollte der Gast die Videoüberwachung ausdrücklich ablehnen, kommt keine Buchung zustande.

   • Careful handling of the inventory
     It is the duty of the guest, to treat the apartment, its furniture, and inventory carefully as if it were his own property. The guest is responsible for all costs of repairing the damage brought about by him intentionally or by improper treatment (eg., burn marks, damaged or extremely dirty furniture / textiles, glass breakage, etc.) in full.
     
   • Responsible use of resources
     It is expected from each guest, that he/she deals responsible with all resources (gas, water, electricity). At extremely improper behavior (keeping the windows open while fully turning up the heating system etc.), we reserve the right to charge additional energy costs.
   • Waste
     Guests are encouraged to dispose of garbage on a regular basis in the designated waste containers in the courtyard.
     
   • Between 10pm and 6am you should not make much noise.
     
   • Motor vehicles
     May be parked in the courtyard of the house, after booking one of the parking lots.
     
10. Access (to be translated)
    Der Gast muss dem Personal von Pilgram Apartments oder von ihm beauftragten Handwerkern jederzeit Zutritt gewähren um Inspektionen, Reinigungen oder Reparaturen durchzuführen. Pilgram Apartments trägt selbstverständlich dafür Sorge, die Privatsphäre des Kunden soweit wie möglich zu wahren und wird den Zutritt wenn möglich zuvor ankündigen.
    Pilgram Apartments behält sich das Recht vor, während der Mietperiode Kontrollen im Apartment durchzuführen oder in dringenden Fällen bei Verdacht auf aufkommende Schäden oder um solche zu beheben, das Apartment ohne Voranmeldung zu betreten.
11. Liability (to be translated)
    Pilgram Apartments haftet für die sorgfältige Bereitstellung des Apartments. Falls bei höherer Gewalt bzw. widrigen Umständen oder aufgrund von Mängeln, Wartungsarbeiten oder anderen betrieblichen Erfordernissen das Apartment nicht bewohnbar oder verfügbar ist, hat Pilgram Apartments das Recht, dem Kunden ein adäquates Alternativangebot zu machen. Der Kunde kann das Alternativangebot annehmen oder kostenlos stornieren. Im Falle eines Eigentümerwechsels bzw. einer Geschäftsaufgabe kann Pilgram Apartments die bestehenden Buchungen einseitig stornieren. In den genannten Fällen beschränkt sich die Haftung von Pilgram Apartments jedenfalls auf die Erstattung der eingezahlten Beträge. Jede weitere Haftung ist ausgeschlossen.
    Der Gast erklärt, aus zeitweiligen Störungen (Wasserzufuhr, Strom, Heizung, Internet, Fernsehempfang u.ä.) keinerlei Rechtsfolgen abzuleiten, sofern diese Störungen weder vorsätzlich noch grob fahrlässig herbeigeführt wurden.
    Der Gast sowie seine Mitreisenden erklären hiermit ausdrücklich, das Apartment, sowie alle Gegenstände des Apartments auf eigene Gefahr zu benutzen und Pilgram Apartments von allen hieraus abzuleitenden Regressansprüchen freizustellen.
    Für alle vom Mieter eingebrachten Wertsachen (auch wenn sie im Tresor verwahrt sind) wird keinerlei Haftung übernommen.
    Pilgram Apartments haftet nicht für Diebstahl, Verlust oder Beschädigung von Eigentum oder Verletzungen und Erkrankungen des Gastes.
    Etwaige Beschwerden oder Mängel des Apartments müssen sofort übermittelt werden, damit Pilgram Apartments so schnell wie möglich die Behebung veranlassen kann. Mängel der Mietsache und der mitvermieteten Gegenstände oder Gefahren, die deren Erhaltung drohen, hat der Mieter Pilgram Apartments unverzüglich mitzuteilen. Der Gast haftet für alle Schäden und Beeinträchtigungen an den vermieteten Räumen und Gegenständen, soweit diese über die durch den ordnungsgemäßen Gebrauch eintretende Abnutzung hinausgehen. Dies gilt auch für Schäden und Beeinträchtigungen durch dritte Personen, die sich mit Zustimmung des Mieters im Apartment aufhalten.
12. Unwirksamkeit einzelner Klauseln (to be translated)
    Soweit einzelne Bestimmungen der AGB von Pilgram Apartments unwirksam sein sollten, hat dies nicht die unmittelbare Unwirksamkeit des gesamten Vertrages zur Folge. An Stelle der ungültigen Regelung soll dasjene treten, was die Parteien in Kenntnis der Unwirksamkeit geregelt hätten, um den wirtschaftlichen Zweck der Vereinbarung zu erreichen. Dies gilt auch für den Fall einer Regelungslücke.
13. Place of jurisdiction
    The place of jurisdiction is 1050 Vienna, Austria. Es gilt ausschließlich österreichisches Recht mit Ausnahme des UN-Kaufrechts.
